The [...] day of September the said Com[m]issioners for and on his Majesty’s behalfe by vertue of the said Com[m]ission and Jeremy Rose of Faughenvale in the late County of Londonderry yoeman doe conclude and agree that the said Jeremy and his assignes shall have [and] hold all that Towneland com[m]only called or knowne by the name of Derriarkyn the lower als[o] Derriarkyn the lesse als[o] Derriarkyn begge with th[e] appurten[an]c[e]s in ffaughenvale aforesaid or by whatsoever other name or names the same be called or knowne conteininge by estimac[i]on threescore and three acres of Irishe measure and all houses, Mess[uage]s, edifices and buildings thereup[p]on and allso all waies and passages unto the aforesaid premisses or any p[ar]te thereof belonginge or fo rmerly enjoyed therewith Exceptinge and reservinge unto his Ma[ies]tie his heirs and Successors all Timber and Timber trees storiers saplinges [and] great trees mynes and quarryes in up[p]on or belonginge to the p[re]misses or any part thereof and all such reasonable waies [and] passages over the p[re]misses for the Te nants and Occupyers of his Ma[ies]t[ie]s other lands as have formerly been used And all Watercourses for and to his Ma[ies]t[ie]s mills in the [...] the Grocers Proporc[i]on and lib[er]ty to make an[...] waterlays in any part of the premisses for the said M[...] River of Loughfoyle and all other Rivers Creekes and st reams in or near to the the premisses and the soyle and ground thereof and all the ffishings [and] taking of Salmons Eeles, and other ffishe in the said Rivers Creekes Streames and ffishings, and liberty to make h ouses and draw their netts and doe any other thinge else whatsoever up[p]on the p[re]misses concerninge the said ffishings for the terme of one and twenty yeares ffrom the ffeast of Phillipp and Jacob now last past for and under the yearly rent of tenn pounds sterlinge paiable into the Receipt of his Ma[ies]t[ie]s Exchecq[ue]r in England or unto the hands of the Receivor of his Ma[ies]ty his heires [and] Successors for the tyme beinge for the Revennue of Londonderry als[o] Derry and Colerane or either of them att the ffeasts of All S[ain]ts and Phillipp and Jacob by equall porc[i]ons up[p]on condic[i]on that the said Terme shall cease and be voyde if the said rent or any p[ar]te thereof shall be behind and unpayd by the space of ffifty dayes next after any of the said ffeasts or dayes of paym[en]t aforesaid And the said Jeremy or some other able and sufficient Ten[a]nt with his ffamily shall from tyme to tyme duringe the said Terme of yeares be resident and Inhabitant in and up[p]on the aforesaid p[re]misses and shall duringe the said Terme grind att his Ma[ies]t[ie]s Mill within the late Mannor of Grocers or Proporc[i]on of land called the Grocers Proportion all his and their mault corne and grayne which he or they shall exp end or use up[p]on the p[re]misses or being ground shall sell to any p[er]son or p[er]sons and pay for grindinge thereof to the Miller of the said Mill for the tyme beinge the sixeteenth part of all the said Mault, Corne, and grayne And shall doe suite att the Court Baron to be holden for such Mannor as his Ma[ies]ty shall erect, create, or make upon or within the said Proporc[i]on from three weekes to three weekes if the same shall be soe often held and shall duringe the said Terme keepe susteyne and maintaine the aforesaid messuages and all other the aforesaid buildings in good and sufficient rep[ar]ac[i]ons. And shall within five yeares now next com[m]inge with dike and double quicksett where quicksett will growe and with other good and sufficient ffences and Inclosures where quicksett will not growe devide sever and make the aforesaid premisses into three severall closes more then now [...] the same are and the same beinge soe devided, made inclosed and severed and all other the hedges ditches and Inclosures up[p]on or belonginge to the aforesaid p[re]misses shall keepe and maintaine well and sufficiently ffenced d itched enclosed and quicksetted duringe the said Terme And shall yearly duringe the said Terme sett and plant up[p]on some part of the aforesaid p[re]misses

The […] day of September, the said commissioners for and on his Majesty’s behalf by virtue of the said commission, and Jeremy Rose of Faughanvale in the late county of Londonderry, yoeman, do conclude and agree that the said Jeremy and his assigns shall have and hold all that townland commonly called or known by the name of Derryarkin Lower, also Derriarkyn the Less, also Derriarkyn Beg, with the appurtenances in Faughanvale aforesaid, or by whatsover other name or names the same be called or known containing by estimation three-score and three acres of Irish measure, and all houses, messuages, edifices, and buildings thereupon, and also all ways and passages unto the aforesaid premises or any part thereof belonging or formerly enjoyed therewith. Excepting and reserving unto his Majesty his heirs and successors all timber and timber trees, storiers, saplings and great trees, mines and quarries in, upon, or belonging to the premises or any part thereof, and all such reasonable ways and passages over the premises for the tenants and occupiers of his Majesty’s other lands as have formerly been used. And all watercourses for and to his Majesty’s mills in the […] the Grocers’ Proportion, and liberty to make an[…] waterlays in any part of the premises for the said M[…], River of Foyle, and all other rivers, creeks, and streams in or near to the the premises and the soil and ground thereof, and all the fishings and taking of salmon, eels, and other fish in the said rivers, creeks, streams, and fishings, and liberty to make houses and draw their nets and do any other thing else whatsover upon the premises concerning the said fishings for the term of one and twenty years from the feast of Phillip and Jacob now last past, for and under the yearly rent of ten pounds sterling payable into the receipt of his Majesty’s Exchequer in England, or unto the hands of the Receiver of his Majesty, his heirs and successors, for the time being, for the revenue of Londonderry, also Derry, and Coleraine or either of them at the feasts of All Saints and Phillip and Jacob by equal portions, upon condition that the said term shall cease and be void if the said rent or any part thereof shall be behind and unpaid by the space of fifty days next after any of the said feasts or days of payment aforesaid. And the said Jeremy or some other able and sufficient tenant with his family shall, from time to time during the said term of years, be resident and inhabitant in and upon the aforesaid premises and shall, during the said term, grind at his Majesty’s mill within the late Manor of Grocers or Proportion of land called the Grocers’ Proportion, all his and their malt, corn, and grain which he or they shall expend or use upon the premises, or being ground shall sell to any person or persons and pay for grinding thereof to the miller of the said mill, for the time being the sixteenth part of all the said malt, corn, and grain. And shall do suit at the court baron to be holden for such manor as his Majesty shall erect, create, or make upon or within the said Proportion, from three weeks to three weeks if the same shall be so often held, and shall during the said term keep, sustain, and maintain the aforesaid messuages and all other the aforesaid buildings in good and sufficient reparations. And shall, within five years now next coming, with dikes and double quicksett where quicksett will grow and with other good and sufficient fences and enclosures where quicksett will not grow, divide, sever, and make the aforesaid premises into three several closes more then now […] the same are, and the same being so divided, made, enclosed, and severed and all other the hedges, ditches, and enclosures upon or belonging to the aforesaid premises shall keep and maintain well and sufficiently fenced, ditched, enclosed, and quicksetted during the said term. And shall yearly during the said term set and plant upon some part of the aforesaid premises
