other parte thereof, And on or be[...] in the yeare of our Lord [...] one thousand sixe hundred fo rty forty and nyne pounds and tenn shillinges residue of the said one hundred t wenty and nine pounds tenn shillinges That then this present contract and and agreement and every thing therein conteined and the lease and grant to be made thereupon cease and be voide Anie thinge herein or in the lease or grant soe to be to the contrary in anywise notwithstandinge, And that his Ma[ies]ty wil[l] be gratiously pleased to ratifie and confirme this agreement by his Letters patent under the greate seale of England, And that the said James shall covenant and grant thereby for him his heires Executors administrators and assigns to performe what is hereby agreed on his parte In witnes whereof the said commissioners and the said James Higgons have put[t] to theire hands the day and year above written:

The [...] day of September The said Com[m]issioners ffor and on his Majesty’s behalf by virtue of the said Com[m]ission, And Christofer ffreeman of Tawghlatt ffinlegan in the late County of London derry gent[leman] do conclude and agree That the said Christofer and his assignes shall have and hold All those twelve townelands com[m]onlie called or knowen by the severall name or names of Ballykeene Bronaherrston Sessaracule Tonbrock Glacke Brougheten Callyloughna, Glasteale more, Glasteele begg Maugheremore and the two ballylawes or by whatsoever other name or names the same or anie of them bee called or knowen conteineinge by estimac[i]on two thousand fower hundred and ninetie acres Irish measure and are lyeinge and beinge in ffaughanvale and Tawghlatt ffinlegan in the said late County, And all Cabbeines edifices and buildinges thereupon, And alsoe one Messuage or tenem[en]t in Tawghlatt ffinlegan aforesaid wherein the said [Christ]ofer nowe dwelleth and all barnes stables edifices and buildinges thereunto belonginge And also all those closes peec[e]s or percells of land and pasture w[i]th th[e] app[ur]ten[a]nc[e]s in Tawghlatt ffinlegan aforesaid and conteineinge by estimac[i]on seaven and thirtie acres Irishe measure, and all Cabbines and buildinges thereupon now or late in the tenure or occupac[i]on of the said [Christ]ofer Raphe Phillips [...] Turance and Marke Greene , or some of them theire or some of their assignes and alsoe one percell of land called Craith in Tawghlatt ffinlegan aforesaid conteineinge by estimac[i]on eighteene acres Irish measure and one other percell of land called Camman wood conteineinge by estimac[i]on tenn acres Irishe measure in Tawghlatt ffinlegan aforesaid And one Com[m]on Mountaine called Slenetarrie in Tawghlatt ffinlegan aforesaid conteineinge by estimac[i]on eight hundred acres Irishe measure And all mills upon the foresaid premisses and lands to the said mills belonginge and the watercourses and waterlayes thereunto belonginge and the Multure toll and grindinge of the mault corne and graine of his Ma[ies]t[ie]s Ten[a]nts within the proporc[i]on called the ffishmongers proporc[i]on in the said late County, And alsoe all wayes and passages unto the foresaid premisses or any parte thereof belonginge or formerly enioyed therew[i]th, Exceptinge and reserveinge unto his Ma[ies]ty his heires and successors the bogg and mosse in the sesseracule aforesaid for his Ma[ies]t[ie]s ten[a]nts, And all timber and timber trees storriers saplinges and greate trees Mynes and Quarries in upon or belonginge to the premisses or anie parte thereof w[i]th full power [and] lib[er]tie

And that his Majesty will be graciously pleased to ratify and confirm this agreement by his letters patent under the Great Seal of England, and that the said James shall covenant and grant thereby for him, his heirs, executors,  administrators, and assigns to perform what is hereby agreed on his part. The […] day of September, the said commissioners for and on his Majesty’s behalf by virtue of the said commission, and Christopher Freeman of Tamlaght Finlagan in the late county of Londonderry, gentleman, do conclude and agree that the said Christopher and his assigns shall have and hold all those twelve townlands commonly called or known by the several name or names of Ballykeen, Broharris,  Sistrakeel, Dunbrock, Glack, Broighter, Callyloughna, Gresteel More, Gresteel Beg, Magheramore, and the two Ballylawes or by whatsoever other name or names the same or any of them be called or known, containing by estimation two thousand four hundred and ninety acres Irish measure and are lying and being in Faughanvale and Tamlaght Finlagan in the said late county, and all cabins, edifices, and buildings thereupon, and also one messuage or tenement in Tamlaght Finlagan aforesaid wherein the said Christopher now dwelleth and all barns, stables, edifices, and buildings thereunto belonging, and also all those closes, pieces, or parcels of land and pasture with the appurtenances in Tamlaght Finlagan aforesaid and containing by estimation seven and thirty acres Irish measure and all cabins and buildings thereupon, now or late in the tenure or occupation of the said Christopher, Ralph Phillips, […] Turance, and Mark Green or some of them, their, or some of their assigns, and also one parcel of land called Craith in Tamlaght Finlagan aforesaid containing by estimation eighteen acres Irish measure, and one other parcel of land called Camman Wood containing by estimation ten acres Irish measure in Tamlaght Finlagan aforesaid, and one common mountain called Slenetarrie in Tamlaght Finlagan aforesaid containing by estimation eight hundred acres Irish measure, and all mills upon the foresaid premises, and lands to the said mills belonging, and the watercourses and waterlays thereunto belonging, and the multure, toll, and grinding of the malt, corn, and grain of his Majesty’s tenants within the Proportion called the Fishmongers’ Proportion in the said late county, and also all ways and passages unto the foresaid premises or any part thereof belonging or formerly enjoyed therewith. Excepting and reserving unto his Majesty, his heirs and successors the bog and moss in the Sistrakeel aforesaid for his Majesty’s tenants. And all timber and timber trees, storiers, saplings and great trees, mines and quarries in, upon, or belonging to the premises or any part thereof, with full power and liberty
