before exc epted to be holden of his Majesty his heirs and successors as of such Mannor as his Majesty shall erect create or make of or within the Proporc[i]on ca lled the Mercers’ Proportion in the said late county by such rents and ser vices as are hereafter menc ioned that is to say yeeldinge and payinge therefore to his Ma[ies]ty his heires and Successors the yearly rent of three pounds of lawfull money of England att the ffeasts of All Saints and Phillip and Jacob by equall porc[i]ons into the Receipt of his Ma[ies]t[ie]s Exchec quer in England or unto the hands of the Receivor of his Ma[ies]tie h is heires and Successors for the tyme beinge for the Revennue of Londonderry als[o] Derry and Colerane or either of them and yeildinge and doinge homage and fealty to his Ma[ies]tie his heyres [and] Successors or to the Lord or Lords of the said Mannor for the tyme beinge and doinge suit att Court in and to the Court Baron to be hold en for the said Mannor from three weekes to three weekes if the sa me shall be soe often held and doinge suit att and to his ma[ies]t[ie]s Mill called Sw atragh Mill within the said Proporc[i]on or late Mannor of Mercers That is to say that he the said Thomas Hudson his heyres and Assignes shall grind att the said Mill and not elsewhere all the corne and graine that shall be used or spent in or uppon the premises or any part thereof and yeildinge and givinge the sixteenth part thereof for the moulture thereof, And for default of paying doing and performinge the aforesaid rent and other services or any part of them or any of them that then his Ma[ies]ty his heirs successors and assignes may distreyne for the same and the said Thomas Hudson or some other able and sufficient tenant with his family shall from time to time for the space of one and twenty years years now next cominge be resident and Inhabitant in and upon the said house and premisses And shall within five yeares now next coming at his and their owne propper costs and chardges well and sufficiently with ditches and ffences double quicksetted or where quicksett will not grow with other fences or Inclosures sever and part all the said premises from the other lands of his Ma[ies]tie and his Ten[a]nts and from the lands of other p[er]sons neere adioyninge unto the p[re]misses And that the said Thomas Hudson his heyres or assignes shall not nor will not demise or lett the p[re]misses or any part thereof nor voluntarily nor willingly suffer the same nor any part thereof to com[m]e to the hands or possession of any p[er]son or p[er]sons whatsoever that shall not then before have taken the oathes of alleagiance [and] suprem acy

before excepted, to be holden of his Majesty, his heirs and successors as of such manor as his Majesty shall erect, create, or make of or within the Proportion called the Mercers’ Proportion in the said late county, by such rents and services as are hereafter mentioned, that is to say, yielding and paying therefore to his Majesty, his heirs and successors the yearly rent of three pounds of lawful money of England at the feasts of All Saints and Phillip and Jacob by equal portions, into the receipt of his Majesty’s Exchequer in England, or unto the hands of the Receiver of his Majesty, his heirs and successors for the time being for the revenue of Londonderry, also Derry and Coleraine or either of them, and yielding and doing homage and fealty to his Majesty, his heirs and successors or to the lord or lords of the said manor for the time being, and doing suit at court in and to the court baron to be holden for the said manor from three weeks to three weeks if the same shall be so often held, and doing suit at and to his Majesty’s mill called Swatragh mill within the said Proportion or late Manor of Mercers. That is to say that he, the said Thomas Hudson, his heirs and assigns shall grind at the said mill and not elsewhere, all the corn and grain that shall be used or spent in or upon the premises or any part thereof, and yielding and giving the sixteenth part thereof for the multure thereof. And for default of paying, doing, and performing, the aforesaid rent and other services or any part of them or any of them, that then his Majesty, his heirs, successors, and assigns may distrein for the same, and the said Thomas Hudson or some other able and sufficient tenant with his family shall, from time to time for the space of one and twenty years years now next coming, be resident and inhabitant in and upon the said house and premises. And shall, within five years now next coming at his and their own proper costs and charges, well and sufficiently with ditches and fences double quicksetted or, where quicksett will not grow, with other fences or enclosures, sever and part all the said premises from the other lands of his Majesty and his tenants, and from the lands of other persons near adjoining unto the premises. And that the said Thomas Hudson, his heirs or assigns shall not nor will not demise or let the premises or any part thereof, nor voluntarily nor willingly suffer the same nor any part thereof to come to the hands or possession of any person or persons whatsoever that shall not then before have taken the oathes of allegiance and supremacy
