appendant to the foresaid p[re]misses or anie part thereof and all such reasonable waies and passages over the p[re]misses for the ten[a]nts and occupiers of his ma[ies]t[ie]s other lands as have formerly binn used and the river of Bann with all other rivers creekes and streames in or neere the p[re]misses and the soile and ground thereof and all the ffishing and takeing of sallmons eeles and other ffishe in the said Rivers creekes and streames and everie or anie of them w[i]th free lib[er]tie for his ma[ies]tie his heires and successors and his and their ten[a]nts ffarmers and ffishers of the said rivers creekes and streames to make houses [and] draw their nett[es] and doe anie other thing else whatsoever uppon the p[re]misses concerning the said ffishings for the terme of one and twenty yeares from the ffeast of Phillip and Jacob now last past for and under the yearly rent of One hundred pounds sterling paiable into the receipt of his ma[ies]t[ie]s Exchequer in England or unto the hands of the Receiver of his Majesty his heirs and successors f or the time being for the Reven[n]ue of Londonderry al[l]s[o] Derry and Coleraine or either of them att the ffeasts of All Saints and Phillip and Jacob yearly by e qual portions upon condition that the said Terme shall cease and be void if the said rent or anie part thereof shall be behind and unpaid by the space of ffifty daies next after anie of the said ffeasts or days of payment aforesaid And that the said Raphe Whistler or some other able and sufficient tenant fit for habitation in the said Capitall messuage with his family shall from time to time during the said term of one and twentie yeares be resident and inhabitant in and uppon the foresaid capital messuage or manor house an d that during the said terme there shal[l] be resident and inhabitant in and upon the foresaid p[re]misses threescore other able and sufficent ten[a]nts with their families And that all the tenants of the foresaid p[re]misses shall during the said terme grind att his ma[ies]t[ie]s mill within the late Manor of Sal all his and their mault corne and graine w[hi]ch he or they shall expend or use upon the premisses or being ground shall sell to anie person or persons and pay for grinding there of to the miller of the said mill for the time being the sixteenthe p[ar]t of all the said mault corne and graine And shall twice in everie yeare of the said terme keepe the said Court Leete and cause the matters and proceedings of the said Court yearly to be fairely written and ingrossed in a booke and att the end of the said terme deliver upp the said booke to the use of his ma[ies]tie his heires and successors And th e said Raphe or his assignes shall within five yeares now next comeing erect and build [and] fu lly finishe uppon the p[re]misses two good and sufficient houses of timber stone or bricke after the ma nner and fashion of Englishe houses everie of the said houses to be two storyes highe and to contei n four roomes att the least And that the said Raphe or his assignes shall during the said terme keep and mainteine the foresaid Capitall messuage or Mannor house and all other the foresaid edifices and buildings in good and sufficient reparac[i]ons and shall within seaven years now next comeing with dike and double quicksett where quicksett will growe and with other good and sufficient fences where quicksett will not growe make sever and devide the foresaid p[re]misses into twentie closes more then the same now are and the same being soe made severed and devided and all other the hedges ditches and inclosures of upon or belonging to [th]e foresaid p[re]misses shall keepe and mainteine well and sufficiently fenced ditched inclosed and quicksetted during the said terme and shall yearly during the said terme sett and p lant upon some part of the foresaid premisses ffourtie young trees of oake or ashe fitt or likely to grow to be timber trees and the same or others to be sett and planted in the roomes and steeds of su ch of them as shall happen to dye shall mainteine preserve and keepe from hurt and spoile during the said terme and att his and their costs and chardges shall for the service of his ma[ies]tie his heirs and successors keepe cleane and decent and well and sufficiently repaired scoured [and] amended from time to time during the said terme ffive musketts furnished [and] Twenty corsletts and pikes furnished formerly delivered and left in the Custodie of the said Raphe Whistler and at the end or other determinac[i]on of the said terme shall leave and deliver the same upp att the said Capitall messuage to the use of his ma[ies]tie his heires and successors And that uppon reasonable request there shal[l] be allowed and sett out to the said Raphe Whistler or his assignes from time to time during the said terme by the Woodward or other officer of his ma[ies]tie his heires and successors rough timber for building the foresaid house soe as aforesaid to be built and other houseboote in convenient places uppon the p[re]misses to be spent uppon the p[re]misses and not elsewhere and that the said Raphe and his assignes shall and may from time to time during the said terme have and take ploughboote Cartboote fireboote and hedgeboote to be taken in and uppon the roots stumps and truncks of trees lyeing on the ground and not fitt for building thornbushes shreadings and lops of trees and underwoods growing uppon the the p[re]misses if the same be there to be had the same to be spent uppon the p[re]misses and not otherwise And that the said Raphe and his assigns shall within two yeares now next comeing fence inclose and encoppice

And that the said Ralph Whistler or some other able and sufficient tenant fit for habitation in the said capital messuage, with his family shall from time to time during the said term of one and twenty years be resident and inhabitant in and upon the foresaid capital messuage or manor house, and that during the said term there shall be resident and inhabitant in and upon the foresaid premises three-score other able and sufficent tenants with their families. And that all the tenants of the foresaid premises shall during the said term grind at his Majesty’s mill within the late Manor of Sal all his and their malt, corn, and grain which he or they shall expend or use upon the premises, or being ground shall sell to any person or persons and pay for grinding thereof to the miller of the said mill, for the time being the sixteenth part of all the said malt, corn, and grain. And shall twice in every year of the said term keep the said court leet and cause the matters and proceedings of the said court yearly to be fairly written and engrossed in a book, and at the end of the said term deliver up the said book to the use of his Majesty, his heirs and successors. And the said Ralph or his assigns shall, within five years now next coming, erect and build and fully finish upon the premises two good and sufficient houses of timber, stone, or brick after the manner and fashion of English houses, every of the said houses to be two stories high and to contain four rooms at the least. And that the said Ralph or his assigns shall during the said term keep and maintain the foresaid capital messuage or manor house and all other the foresaid edifices and buildings in good and sufficient reparations, and shall within seven years now next coming, with dikes and double quicksett where quicksett will grow and with other good and sufficient fences where quicksett will not grow, make, sever, and divide the foresaid premises into twenty closes more then the same now are, and the same being so made, severed, and divided, and all other the hedges, ditches, and enclosures of, upon, or belonging to the foresaid premises, shall keep and maintain well and sufficiently fenced, ditched, enclosed, and quicksetted during the said term, and shall yearly during the said term set and plant upon some part of the foresaid premises forty young trees of oak or ash fit or likely to grow to be timber trees, and the same or others to be set and planted in the rooms and steads of such of them as shall happen to die shall maintain preserve and keep from hurt and spoil during the said term, and at his and their costs and charges shall, for the service of his Majesty, his heirs and successors, keep clean and decent and well and sufficiently repaired, scoured, and amended from time to time during the said term, five muskets furnished and twenty corslets and pikes furnished, formerly delivered and left in the custody of the said Ralph Whistler, and at the end or other determination of the said term shall leave and deliver the same up at the said capital messuage to the use of his Majesty, his heirs and successors. And that upon reasonable request there shall be allowed and set out to the said Ralph Whistler or his assigns from time to time during the said term, by the Woodward or other Officer of his Majesty, his heirs and successors, rough timber for building the foresaid house so as aforesaid to be built, and other houseboot in convenient places upon the premises to be spent upon the premises and not elsewhere, and that the said Ralph and his assigns shall and may from time to time during the said term have and take ploughboot, cartboot, fireboot, and hedgeboot, to be taken in and upon the roots, stumps, and trunks of trees lying on the ground and not fit for building, thornbushes, shreddings and lops of trees, and underwood growing upon the the premises if the same be there to be had, the same to be spent upon the premises and not otherwise. And that the said Ralph and his assigns shall within two years now next coming fence, enclose, and encoppice
