and that the said Ferdora O’Cahan or his assigns shall at his or their prop[er] costs and charges within [...] years now next com[m]inge erect and build and fully finish upon the premisses one sufficient and substantiall house of timber stone or bricke after the fashion and manner of an English house two stories high att the least and conteininge [...] roomes att the least. And that the said fferdora his heires or assigns or some sufficient Ten[a]nt with his ffamily shall from tyme to time for and during the space of one and twenty yeares next com[m]inge after the said house shall be soe as aforesaid built and finished be resident [and] inhabitant in and up[p]on the said premisses and shall within five yeares next ensuinge att his and their owne prop[er] costs and charges well and sufficiently with ditches and quicksett where quicksett will growe or with other good and sufficient ffences and inclosures, where quicksett will not growe, sever and part all the said premisses from the other lands of his Ma[ies]ty and his Ten[a]nts and from the lands of other p[er]sons neere adioining unto the premisses, and the same shall from tyme to tyme p reserve and keepe and that the said fferdora his heyres, or assignes shall not nor will not demise or lett the premisses or any part thereof nor volun tarily nor willingly suffer the same or any part thereof to come to the hands or possession of any p[er]son or p[er]sons whatsoever that shall not then have taken the oathes of alleagiance and supremacy before some Iustice of the peace or others in that behalfe lawfully authorised And the said fferdora O Cahan shall up[p]on reasonable request have assigned and sett out unto him by the Woodward or other officer of his Ma[ies]tie soe much good and sufficient rough tymber in and up[p]on the pre mises if the same be there to be had, as shall be fitt and necessary to be used in b uilding the said howse, And that his Ma[ies]tie will be gratiously pleased by letters Patents under the great Seale of England to ratif y and confirm this agreement and that the said fferdora shall covenant and grant thereby for him his heires Executors, Administrators and assigns to p[er]forme what is hereby agreed on his part In Wittnes whereof the said Com[m]issioners and the said fferdoragh O Cahan have put to their hands the day and yeare abovewritten:

The said seaventh day of August the aforesaid Com[m]is sioners for and on his Ma[ies]t[ie]s behalfe by vertue of the said Com[m]ission and Rory Ront O’Cahan of Errigell in the late County of Londonderry g entleman do conclude and agree that the said Rory Ront O Cahan his heires and assigns shall have and hold for ever. All that Towneland com[m]on ly called or known by the name of Calnesellagh with the appurten[an]c[e]s p[ar]cell of the Balliboe [...] and heretofore p[ar]cell of the lands and possessions of Manus McCoey valley O Cahan gent[leman] deceased or by whatsoever other name or names the same be called or knowne, And all the Cabyns, how ses edifices and buildings thereup[p]on all which premisses are lying and being in Erregell aforesaid within the Proporc[i]on of land c alled the Ironmongers’ Proporc[i]on or late Mannor of Lizard in the late County of Londonderry and also all waies and passages to the aforesaid prem ises or any part thereof belonginge or therew[i]th enioyed The same prem ises to be holden

and that the said Ferdora O’Cahan or his assigns shall, at his or their proper costs and charges within […] years now next coming, erect and build and fully finish upon the premises one sufficient and substantial house of timber, stone, or brick after the fashion and manner of an English house two stories high at the least and containing […] rooms at the least. And that the said Ferdora, his heirs or assigns or some sufficient tenant with his family shall, from time to time for and during the space of one and twenty years next coming after the said house shall be so as aforesaid built and finished, be resident and inhabitant in and upon the said premises, and shall, within five years next ensuing at his and their own proper costs and charges, well and sufficiently with ditches and quicksett where quicksett will grow or with other good and sufficient fences and enclosures where quicksett will not grow, sever and part all the said premises from the other lands of his Majesty and his tenants, and from the lands of other persons near adjoining unto the premises, and the same shall from time to time preserve and keep, and that the said Ferdora, his heirs or assigns shall not nor will not demise or let the premises or any part thereof, nor voluntarily nor willingly suffer the same or any part thereof to come to the hands or possession of any person or persons whatsoever that shall not then have taken the oaths of allegiance and supremacy before some Justice of the Peace or others in that behalf lawfully authorised. And the said Ferdora O’Cahan shall, upon reasonable request, have assigned and set out unto him by the Woodward or other Officer of his Majesty, so much good and sufficient rough timber in and upon the premises if the same be there to be had as shall be fit and necessary to be used in building the said house. And that his Majesty will be graciously pleased by letters patent under the Great Seal of England to ratify and confirm this agreement, and that the said Ferdora shall covenant and grant thereby for him, his heirs, executors, administrators, and assigns to perform what is hereby agreed on his part. In witness whereof the said commissioners and the said Ferdora O’Cahan have put to their hands the day and year abovewritten:

The said seventh day of August, the aforesaid commissioners for and on his Majesty’s behalf by virtue of the said commission, and Rory Ront O’Cahan of Errigal in the late county of Londonderry, gentleman, do conclude and agree that the said Rory Ront O’Cahan, his heirs and assigns shall have and hold forever all that townland commonly called or known by the name of Coolnasillagh, with the appurtenances, parcel of the balliboe […] and heretofore parcel of the lands and possessions of Manus McCoey Ballagh O’Cahan, gentleman, deceased, or by whatsoever other name or names the same be called or known. And all the cabins, houses, edifices, and buildings thereupon, all which premises are lying and being in Errigal aforesaid within the Proportion of land called the Ironmongers’ Proportion or late Manor of Lizard in the late county of Londonderry, and also all ways and passages to the aforesaid premises or any part thereof belonging or therewith enjoyed.
