hurt and spoile dureinge the said terme, And shall at his and their proper costes and charges dureinge the said terme have and keepe in r eadiness upon the foresaid premisses for the service of his Ma[ies]ty his heires and succ essors ffower pikes ffower Corsletts and fower musketts furnished in such man ner as the same shall and may be allowed by the Muster Master of the Coun ty in w[hi]ch the premisses are for the time beinge, And that upon reasonable request there shal[l] be allowed and sett out unto the said Christofer or his assignes from time to time dureinge the said terme by the woodward or other Officer of his Ma[ies]ty his heires and successors rough timber for buildinge and repairinge the foresaid howses and howseboote in convenient places w[i]thin the late County of London-derry to be spent upon the premisses and not els where and that the said Christofer and his assignes shall and may from time to time duringe the said terme have and take fireboote and hedgeboote to be taken in and upon the root[e]s stumpes trunkes and bodyes of Deade trees fallen or lying upon the ground, thornes bushes shreadinges and lopps of trees and underwoods groweinge upon the premisses if the same be there to be had the same to be spent upon the premisses and not otherwise, And that his Majesty will be gratiously pleased to ratifie and confirme this agreem[en]t by his letters Patents under the greate seale of England And that the said [Christ]ofer shall coven[a]nt and grant thereby for him his heires executo[r]s administrators and assignes to performe what is hereby agreed on his parte. The Twentieth day of the said moneth of September, The foresaid Com[m]ission[er]s for and on his Ma[ies]t[ie]s behalfe by vertue ofthe said Com[m]ission And John Monntgomery of Desert Lynn in the late Countie of London-derry gent[leman] doe conclude and agree That the said John and his assignes, shall have and hold, All that towneland com[m]onlie called or knowen by the name of Bally hally in Comer als[o] Cumber in the said late County or by whatsoever other name or names the same be called or knowen conteyninge by estimac[i]on nine hundred and thirtie acres Irish measure, w[i]th all wayes and passages unto the premisses or any parte thereof belonginge or formerlie enioyed therew[i]th, w[i]th the like Excepc[i]ons and for the terme of one and twentie yeares ffrom the ffeast of Phillip and Jacob nowe last past for and under the yearly rent of seaventeene pounds and tenn shillinges sterlinge, Payable in such manner and at such dayes and tymes and w[i]th under and upon such further and the like condic[i]on coven[a]nts and agreem[en]ts as in the foresaid Agreem[en]t made by the said Com[m]issio[ner]s and the said John Monntgomery before named are conteyned save onely that the said John is not by this Agreem[en]t bound or tyed to build a house as by his former agreem[en]t hee is to doe In witnesse whereof the said Com[m]issioners and the said John have put[t] to their hands the day and yeare above written:

And shall, at his and their proper costes and charges during the said term, have and keep in readiness upon the foresaid premises, for the service of his Majesty, his heirs and successors four pikes, four corslets, and four muskets furnished in such manner as the same shall and may be allowed by the Muster Master of the county in which the premises are for the time being. And that upon reasonable request there shall be allowed and set out unto the said Christopher or his assigns, from time to time during the said term by the Woodward or other Officer of his Majesty, his heirs and successors rough timber for building and repairing the foresaid houses, and houseboot in convenient places within the late county of Londonderry, to be spent upon the premises and not elsewhere, and that the said Christopher and his assigns shall and may, from time to time during the said term, have and take fireboot and hedgeboot to be taken in and upon the roots, stumps, trunks, and bodies of dead trees fallen or lying upon the ground, thornbushes, shreddings and lops of trees, and underwood growing upon the premises if the same be there to be had, the same to be spent upon the premises and not otherwise. And that his Majesty will be graciously pleased to ratify and confirm this agreement by his letters patent under the Great Seal of England. And that the said Christopher shall covenant and grant thereby for him, his heirs, executors, administrators, and assigns to perform what is hereby agreed on his part. John Montgomery

The twentieth day of the said month of September, the foresaid commissioners for and on his Majesty’s behalf by virtue ofthe said commission, and John Montgomery of Desertlyn in the late county of Londonderry, gentleman, do conclude and agree that the said John and his assigns shall have and hold all that townland commonly called or known by the name of Ballyholly in Comer, also Cumber [Cumber Upper], in the said late county or by whatsoever other name or names the same be called or known, containing by estimation nine hundred and thirty acres Irish measure, with all ways and passages unto the premises or any part thereof belonging or formerly enjoyed therewith, with the like exceptions and for the term of one and twenty years from the feast of Phillip and Jacob now last past, for and under the yearly rent of seventeen pounds and ten shillings sterling payable in such manner and at such days and times and with, under, and upon such further and the like condition, covenants, and agreements as in the foresaid agreement made by the said commissioners and the said John Montgomery beforenamed are contained, save only that the said John is not by this agreement bound or tied to build a house as by his former agreement he is to do. In witnesse whereof the said commissioners and the said John have put to their hands the day and year abovewritten:
