and Henry and their assignes by the Wo odward [...] anie tyme being soe much roughe timber as shal[l] be necessarie for the bu ilding and repairing of the p[re]misses and that the said Symon William and Henry a nd their assignes shall have lib[er]tie uppon such request and by such assignement as af oresaid to digg take and carry away out of some of his ma[ies]t[ie]s mynes or quarryes suf ficient stone if the same be there to be had for the building and rep[ar]ing the aforesaid p[re]misses and that the said Symon William and Henry their deputyes [and] ass igns shall and will during the said terme use the best diligence and care w[hi]ch they and every of them cann or may in giving notice and allsoe in makeing stay that noe goods shall or may be brought to or loaded from the said Key or wharfe but such as the custome and subsedy thereof shal[l] be before hand duely paid or secured to his ma[ies]tie his heires or successors. The said one and thirtieth day of August the said S[i]r Raphe Whitfeld and Thomas ffo therley his ma[ies]t[ie]s Commissioners for and on his ma[ies]t[ie]s behalfe by vertue of the said Commission and Symon Pitts and Henry ffinche two of the Aldermen of the late Citty of Londonderry and Robert Goodwyn Chamb[er]lain of the said late Citty doe conclude and agree that the said Symon Henry and Robert and their assignes shall have and hold one Windmill and one horsemill in the Island of Derry with th[e] appurten[a]nc[e]s within the lib[er]ties of the said late Citty and allsoe all the moulture soake and grinding of mault corne and graine att and in the said mills and in such other mills as according to this agreement are to be built and erected of all the ten[a]nts and inhabitants of his ma[ies]t[ie]s houses and lands w[hi]ch are within the late Ci ty of Londonderry or the lib[er]ties thereof lyeing on that side of the River of Loughfoile on w[hi]ch the s aid late Citty is built and all watercourses waies and passages to the mills to be erected according to this agreem[en]t and all those severall peeces and p[ar]cells of land with th[e] appurten[a]nc[e]s conteining by estimac[i]on seaven acres Irishe measure and now or late in the severall tenures or occupac[i]ons of Robert Thornton John Ellvyn Samuell Dawson John Hawkes John Pallmer John Boyd John Kneeland Henry Sollers Richard Burdus Henry Addison Gabriell Larggs Walter Hamilton Richard Mutter John Westgate George Sanders Richard Morrice and Dame Ann Brooke widdow or their or some of their assignes and lyeing and being together on the Island of Derry and all waies and passages to the foresaid p[re]misses or anie p[ar]t thereof belonging or formerly enioyed therewith for the terme of one and Thirty years from the ffeast of St Michaell Th[e] archangell now next comeing for and under the yearly rent ffourty pounds sterling for the first yeare of the said one and thirty yeares paiable att the ffeasts of Th[e] an[n]u[n]ciac[i]on of the blessed virgin Mary and St Michaell Th[e] archangell by equall porc[i]ons and for and under the yearly rent of Threescore pounds sterling for the thirty yeares Residue of the said one and thirty yeares paiable att the ffeasts of Th[e] an[n]unciac[i]on of the Blessed v irgin Mary and St Michaell Th[e] archangell by equall porc[i]ons the said rents to be paid to his ma jesty his heirs and successors into the receipt of his ma[ies]t[ie]s Exchequer in England or unto the hands of the Receiver of his ma[ies]tie his heires and Successors for the time being for the Reven[n]ue of Lo ndonderry also Derry and Colerane or either of them uppon condic[i]on that the said terme shall cease [and] be void if the said rent or anie part thereof shal[l] be behind and unpaid by the space of ffifty daye s next after anie of the said ffeasts or daies of paim[en]t aforesaid and the said Symon Henry and William and their assignes shall att their propp[er] costs and chardges within three yeares now n ext coming [...] uppon [...]

and Henry and their assigns by the Woodward  […] any time being so much rough timber as shall be necessary for the building and repairing of the premises, and that the said Simon, William, and Henry and their assigns shall have liberty upon such request and by such assignement, as aforesaid, to dig, take, and carry away out of some of His Majesty’s mines or quarries sufficient stone, if the same be there to be had, for the building and repairing the aforesaid premises, and that the said Simon, William, and Henry, their deputies and assigns shall and will during the said term use the best diligence and care which they and every of them can, or may, in giving notice and also in making stay that no goods shall or may be brought to or loaded from the said quay or wharf, but such as the custom and subsidy thereof shall be beforehand duly paid or secured to His Majesty, his heirs or successors. And that His Majesty will be graciously pleased to confirm this agreement by his letters patent under the Great Seal of England, and that the said Simon, William, and Henry shall covenant and grant thereby for them, their heirs, executors, administrators, and assigns to perform what is hereby agreed on their parts, In witness whereof the said commissioners and the said Simon, William, and Henry have put to their hands the day and year abovewritten:

The said one and thirtieth day of August, the said Sir Ralph Whitfeld and Thomas Fotherley, His Majesty’s commissioners, for and on His Majesty’s behalf by virtue of the said commission, and Simon Pitts and Henry Finch, two of the Aldermen of the late city of Londonderry, and Robert Goodwin, Chamberlain of the said late city, do conclude and agree that the said Simon, Henry, and Robert and their assigns shall have and hold one windmill and one horsemill in the Island of Derry, with the appurtenances, within the Liberties of the said late city, and also all the multure, soak, and grinding of malt, corn, and grain at and in the said mills and in such other mills as, according to this agreement, are to be built and erected, of all the tenants and inhabitants of His Majesty’s houses and lands which are within the late city of Londonderry or the Liberties thereof lying on that side of the River of Foyle on which the said late city is built, and all watercourses, ways, and passages to the mills to be erected according to this agreement, and all those several pieces and parcels of land, with the appurtenances, containing by estimation seven acres Irish measure and now or late in the several tenures or occupations of Robert Thornton, John Elvin, Samuel Dawson, John Hawkes, John Palmer, John Boyd, John Kneeland, Henry Sollers, Richard Burdus, Henry Addison, Gabriel Larggs, Walter Hamilton, Richard Mutter, John Westgate, George Sanders, Richard Morrice, and Dame Anne Brook, widow, or their, or some of their, assigns, and lying and being together on the Island of Derry, and all ways and passages to the foresaid premises or any part thereof belonging or formerly enjoyed therewith, for the term of one and thirty years from the feast of St Michael the Archangel now next coming, for and under the yearly rent forty pounds sterling for the first year of the said one and thirty years, payable at the feasts of the Annunciation of the Blessed Virgin Mary and St Michael the Archangel by equal portions, and for and under the yearly rent of three-score pounds sterling for the thirty years residue of the said one and thirty years, payable at the feasts of the Annunciation of the Blessed Virgin Mary and St Michael the Archangel by equal portions, the said rents to be paid to His Majesty, his heirs and successors, into the receipt of His Majesty’s Exchequer in England, or unto the hands of the Receiver of His Majesty, his heirs and successors, for the time being for the revenue of Londonderry, also Derry, and Coleraine or either of them, upon condition that the said term shall cease and be void if the said rent or any part thereof shall be behind and unpaid by the space of fifty days next after any of the said feasts or days of payment aforesaid, and the said Simon, Henry, and William and their assigns shall, at their proper costs and charges within three years now next coming, […] upon  […]
